By accessing and using TalentCycle's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, please do not use our services.
TalentCycle works to provide comprehensive HR services including executive search, temporary and permanent staffing, HR consulting, talent management, employer branding, payroll administration, and HR technology implementation for mid-market employers.
To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account.
Clients agree to work to provide accurate job descriptions, compensation information, and company details. Clients must comply with all applicable employment laws and regulations and work to provide a safe, non-discriminatory work environment.
Candidates agree to work to provide accurate and complete information about their employment history, qualifications, and availability. Misrepresentation of qualifications or experience may result in termination of services.
Payment terms vary by service type and are outlined in separate service agreements. Executive search fees are typically due upon successful placement. Temporary staffing fees are generally billed weekly or bi-weekly. Consulting and implementation project fees are outlined in separate service agreements.
All content, trademarks, and intellectual property on our website and in our services remain the property of TalentCycle or our licensors. You may not reproduce, distribute, or create derivative works without our express written permission.
We work to maintain confidentiality regarding client and candidate information. Both parties agree to keep confidential any proprietary information shared during the course of our business relationship, subject to applicable law.
To the extent permitted by law, TalentCycle's liability is limited to the fees paid for our services. We are not liable for indirect, incidental, or consequential damages arising from the use of our services, except as required by applicable law.
Either party may terminate services with written notice as outlined in the applicable service agreement. Upon termination, outstanding fees may become due and payable as specified in the agreement. Confidentiality obligations survive termination.
Any disputes arising from these terms may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York, NY, unless otherwise specified in your service agreement.
These Terms of Service are governed by the laws of the State of New York, without regard to conflict of law principles.
Neither party shall be liable for any failure to perform due to circumstances beyond their reasonable control, including natural disasters, government actions, or other unforeseeable events, subject to applicable law.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable to the extent permitted by law.
We reserve the right to modify these terms at any time. Changes will be effective as specified when posted on our website. Continued use of our services may constitute acceptance of modified terms, subject to applicable law.
